What is your warranty?

Kitchen & Bath Design Group (“KBDG”, “We”, or “Us”) extends the following limited warranty (“Limited Warranty”) to the Purchaser with respect to cabinets, countertops, backsplashes, vent hoods, lighting, appliances, decorative hardware, and appliances provided and installed by KDBD or KBDG’s subcontractor (“Product(s)”). As used in this Limited Warranty, “You”, “Your”, and “Purchaser” each means or refer to the individual person(s) who, or entity that, originally engaged KBDG to provide and install the Products.

What does the warranty cover?

Subject to the exclusions and limitations set forth in this Limited Warranty, We warrant to You that each of the Products will be free from defects in material and workmanship, under normal use and maintenance, for one (1) year from the date of installation of the Products (the “Warranty Period”). Certain Products covered by this Limited Warranty may also be covered by a separate warranty provided by the manufacturer(s) of the Products. Appliances installed by KDBD or KBDG’s subcontractor are covered by this Limited Warranty only to the extent that the appliances were incorrectly installed, and any defects in the appliances are not covered by this Limited Warranty, but are often covered by the appliance manufacturer’s warranty.

What is not covered?

This Limited Warranty does NOT cover: Naturally occurring characteristics of wood and other materials in the Products, such as, but not limited to, variations in color, variations in grain pattern, and knots. Variations in color, grain pattern, and knots are not considered defects in the Product, even if visible through painted finishes. Changes in the Product over time due to inherent characteristics of wood. Natural woods may vary in color and characteristics and exhibit subtle changes as they age. For example, painted doors, drawer fronts, and face frames may initially or with time exhibit visible cracking around the joint area, typically due to normal expansion and contracting of the wood resulting from humidity level fluctuations. Cabinet colors whether or not painted may darken or lighten over time due to exposure to sunlight, smoke, household cleaners and other environmental conditions. Variations in the Product from samples and displays, due to inherent characteristics of materials:

Wood varies significantly from piece to piece. Wood finishes change in sheen and color overtime due to exposure to natural and artificial light and other environmental factors. Because of this, new and/or replacement cabinets may not match showroom displays, color chip samples, photographs in catalogs or websites, or existing cabinetry in Your premises.
Natural materials such as marble, soapstone, and limestone, due to their inherent nature, will vary significantly in color and pattern from piece to piece. Because of this, new and/or replacement Products made of these materials may not match showroom displays, color chip samples, photographs in catalogs or websites, or existing items in Your premises.
The appearance of stainless steel on Products, such as appliances and vent hoods, may vary between manufacturers and may vary from year to year even from the same manufacturer. Because of this, stainless steel on Products from different manufacturers may have different appearances from one another even when new, and replacement Products may not match existing Products. If we replace a defective or damaged stainless steel Product under this Limited Warranty, we will only replace the involved Product and cannot guarantee that the stainless steel replacement Product will match the existing stainless steel Products.

Incidental deterioration of Product such as nicks, scratches, abrasions, and normal aging, whether from the effects of wear and tear from normal use of the Product or from the effects of abnormal use of the Products. Damage to Products caused by ordinary wear and tear. Damage to Products caused by misuse, abuse, neglect, negligence, accident, alteration, improper use, exposure to moisture or extreme temperatures or humidity, or other environmental factors in the premises in which the cabinets are installed, including damage due to smoke, fire, mold, flood, failure to maintain, vandalism, or acts of God. An example of damage due to exposure to moisture is a wood or butcher block countertop, which due to its nature, is susceptible to warping and color changes resulting from exposure to water, such as from a kitchen sink, and therefore this Limited Warranty does not cover water or moisture damage to wood or butcher block countertops. Staining of countertops and other Products made of naturally porous materials such as marble, soapstone, limestone, wood, or concrete. Burn marks, deformation, or cracking due to heat. Product installed or used outdoors. Product used for purposes for which it is not designed or intended by Us. Product which has been subjected to modifications by or under the direction of Purchaser that have not been authorized by KBDG Product which has been improperly cleaned, or maintained, or that exhibits effects on the color and/or integrity of the finish or appearance due to the use of abrasive cleaners, cleaners that contain chlorine, acidic cleaners, scuffing sponges or steel wool. (For more information regarding the proper use and care of the Products, please consult the applicable Use and Care Instructions that accompanied the respective Products. This Limited Warranty only covers Products provided and installed by KBDG or KBDG’s subcontractor, and does not cover other items that were not provided and installed by KBDG or KBDG’s subcontractor(the “Other Items”) even if those Other Items were installed, used, or intended to be used in connection with the Products. Therefore, this Limited Warranty does not cover the costs to remove, reinstall, or replace such Other Items.

Sole and Exclusive Remedy

In the event of a defect in material or workmanship with respect to any Products within the terms and conditions set forth in this Limited Warranty that has been reported to Us in writing during the Warranty Period, We will repair or replace the Product, at Our sole option, without charge. This is Your sole and exclusive remedy. The repair or replacement offered by Us under this Limited Warranty is contingent on the current Product offerings of styles and construction options within the relevant Product line at the time of a warranty claim is made by You. If We choose to replace the affected Product or component with a new Product, the new Product or component will be of the same or approximately the same style and color from Our current Product line or offerings. If a Product or component is repaired or replaced, We cannot guarantee an exact match with the finish or appearance of other Products or Other Items installed at the Your premises. Repaired or replaced Product shall be warranted for a period equal to the remaining period of the original Limited Warranty on the Product or for ninety (90) days, whichever is longer. Notwithstanding the above, if a claim for warpage or joint separation is submitted, We may, at Our option and after inspection, defer action for up to twelve (12) months after receipt of Your warranty claim to allow the Product to acclimate to the installed environment. We reserve the right to modify or alter any Product or Product component design, specifications or materials without obligation to make similar changes to Products previously manufactured, sold, or installed by Us. THIS LIMITED WARRANTY SETS OUT THE FULL EXTENT OF KBDG’S RESPONSIBILITIES, AND THE EXCLUSIVE REMEDY REGARDING THE PRODUCTS. ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. IN NO EVENT SHALL KBDG BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE AND INSTALLATION PRICE OF THE PRODUCT OR FOR, WITHOUT LIMITATION, COMMERCIAL LOSS OF ANY SORT; LOSS OF USE, TIME, DATA, REPUTATION, OPPORTUNITY, GOODWILL, PROFITS OR SAVINGS; INCONVENIENCE; INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT. SOME STATES AND JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE DISCLAIMER OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND DISCLAIMERS MAY NOT APPLY TO YOU. IF ANY PORTION OF THIS LIMITED WARRANTY IS HELD TO BE ILLEGAL OR UNENFORCEABLE, SUCH PARTIAL ILLEGALITY OR UNENFORCEABILITY SHALL NOT AFFECT THE ENFORCEABILITY OF THE REMAINDER OF THE LIMITED WARRANTY. The remedies described above are Your sole and exclusive remedies and Our entire liability under, or for any breach of, this Limited Warranty. Our total liability shall under no circumstances exceed the actual amount paid by You for the affected or defective Product.

How do you make a warranty claim?
